Fifteen Kenyan smallholder farmers are challenging the constitutionality of the Seeds and Plant Varieties Act (Cap 326 2012) which they allege criminalizes the saving, exchange and informal distribution of farmer-developed seed varieties. The petition supported by Seed Savers Network, Greenpeace and the Biodiversity and Biosafety Association of Kenya (BIBA), is set for ruling at Machakos High Court (Constitutional & Human Rights Division) in November and will determine whether the law violates farmers’ constitutional rights to save, share and preserve their own seeds.
